New contributions of the thesis:

1. The thesis is the first scientific work that researches comprehensively, systematically the theory and practice of state management of the Customs in the fight against smuggling and trade frauds. The thesis has developed the concept, characteristics, contents, forms and measures of state management in the fight against smuggling and trade fraud according to the functions of the Customs. The results of the thesis have enriched the theoretical system of state management on security and order in general and the state management on the fight against smuggling and trade fraud in particular.

2. The thesis has analyzed and indicated the situation related to the state management of the fight against smuggling and trade fraud according to the functions of the Customs such as: current situation, process, structure, nature of the situation of smuggling and trade frauds in the areas under the control of the Customs. The thesis has accurately assessed the reality of the state management in the fight against smuggling and trade fraud under the function of the Customs and the reality of coordination between the forces as well as international cooperation on this field of Vietnam Customs.

3. The thesis has pointed out typical evidences associated with the application of contents and measures of state management in the fight against smuggling and trade frauds of the Customs. Accordingly, the thesis has analyzed and evaluated the achievements as well as the shortcomings, limitations and causes of shortcomings and limitations in the implementation of this task according to their functions.

4. On the basis of theoretical awareness and survey, evaluation of the reality, the thesis has made scientific forecasts as a basis for proposing 06 groups of solutions to improve the effectiveness of state management in fight against smuggling and trade frauds of Vietnam Customs in the coming time. The thesis has emphasized the following solutions:

- Advising, proposing, supplementing, amending and perfecting the law in order to enhance the efficiency of state management in the fight against smuggling and trade frauds; formulating regulations defining clearly the responsibility of enterprises engaged in goods transportation and warehouse business; the cooperation between the Border Guards and the Customs on the competence in the initial investigation; dealing with problems in criminal handling and administrative violations in general and the specific violations of CITES, temporary import for re-export of goods;

- Comprehensively reforming the forms and measures of the State management of Vietnam Customs in the fight against smuggling and trade frauds through inspection, supervision, control, application of risk management, compliance management and customs control measures.
