New contributions of the thesis:
Investigation of intentional wounding cases caused by
prisoners in the detention centers according to the function of Criminal
Enforcement Police and Justice Assistance is the initial investigation
activities in the investigation stages when intentional wounding cases caused
by prisoners occur in the detention centers. Paragraph 2, Article 111 of the
Criminal Procedure Code, 2003 stipulated that in the People’s Police and the
People’s Army, apart from the investigating bodies prescribed in Article 110 of
this Code, if other agencies assigned to conduct a number of investigating
activities detect cases showing criminal signs while performing their tasks,
they shall have the right to institute criminal cases, conduct initial
investigating activities and transfer the case files to competent investigating
bodies within seven days after issuing the decisions to institute criminal
cases. On that basis, Article 23 of Ordinance of Organization of Criminal
Investigation in 2004 states: detention camp while doing their duties, which
detect the signs of the crime under the jurisdiction of the investigating
police agency to investigate the provisions of Article 11 of this Ordinance,
Superintendent of Prisons decides prosecute the case, taking testimony, examine
the scene, examination review, seizure, custody and preserve physical evidence
and documents directly related to the case, transfer the case file to the
investigating police agency that has jurisdiction within seven days from the
date of the decision to prosecute the case.
Therefore, the study of the
investigative activities in the initial investigation stage of the intentional
wounding cases caused by prisoners in accordance with the functions of the
Criminal Enforcement Police Force and Judicial Assistance is the principles to
orient the solutions contributing to improving operational efficiency in the
future. In fact, the initial investigation of the intentional wounding cases occurring
in prisons has achieved some positive results; however, it still reveals some
certain outstanding restrictions. Hence, it is necessary to ensure the
investigative activities in the initial investigation stage of Criminal Enforcement
Force and Judicial Assistance under the provisions of law and the guidance of
the science of criminal investigation to contribute to improve the efficiency
of this activity in the future.
This is the in-depth
study of the investigative activities in the initial investigation phase in
function of Criminal Enforcement Police and Judicial Assistance. The research
results of the thesis shall contribute to supplementing and completing
additional arguments for the initial investigation of cases performed by
inmates in detention centers under the Ministry of Public Security. The thesis
proposes some solutions to improve the efficiency of investigation activities of
intentional wounding cases caused by
prisoners executed in detention centers according to the functions of
Criminal Enforcement Police and Judicial Assistance in the near future.
