Temporary custody and detention are preventive measures defined in the Criminal Procedures Code. Implementation at temporary custody and detention centers has recently organized closely under the regulation of law, serving effectively investigation, prosecution, judgment and sentence enforcement, contributing to crime prevention, ensuring national security, social order and safety, protecting human rights and legal interests of citizens.

However, before the complex crime situation, the legal basis of the work of temporary custody and detention gradually revealed many shortcomings. To overcome these problem, on November 25^th, 2015, the National Assembly issued the Law on Temporary Custody or Detention Enforcement regulating in detail the social relations arising in the field of ​​temporary custody and detention, especially managing subjects being in temporary custody and detention of Criminal Sentence Enforcement and Judicial Assistance Police.

Overview of the workshop

At the seminar, the delegates focused on clarifying new regulations in Law on Temporary Custody and Detention Enforcement in 2015; properly assessing situation of temporary custody and detention currently; difficulties and obstacles in process of organization, management, implementation of temporary custody, detention, particularly in view of the legal basis of this operation; forecasting difficulties and advantages when implementing provisions of the Law and making proposals and recommendations for implementing favorably the Law.

Basing on the study, assessment of practical situation, difficulties and obstacles in the process of organization, management, implementation of the temporary custody and detention, the delegates reiterated the Law on Temporary Custody and Detention Enforcement in 2015 had adjusted, modified and supplemented in order to overcome practical problems with important new regulations such as ensuring the human right in custody or detention, enhancing effectiveness of state management on temporary custody and detention, meeting the requirements of the Constitution in 2013, ensuring uniformity, consistency with the legal system.

To improve the efficiency of provision enforcement of the Law on Temporary Custody and Detention Enforcement in 2015, the delegates proposed to propagandizing the Law deeply and widely in the national scale to enhance responsibility, cooperation and consensus of the people, agencies in implementing the Law. The General Department of Criminal Sentence Enforcement and Judicial Assistance and Public Security of provinces should open training courses on the Law and propagandize deeply and widely for officers and soldiers, temporary detainees the basic contents, especially regulation on rights and obligations of persons being in temporary custody or detention; simultaneously also improving the quality and stability of the staff of officers working in custody or detention centers. After graduation, students of the Criminal Sentence Enforcement and Judicial Assistance Faculty have to work in custody or detention centers for at least 5 years, etc.

The workshop assessed accurately and objectively difficulties and advantages when implementing provisions of the Law on Temporary Custody and Detention Enforcement in 2015. This will be a scientific basis to complete research results of the special theme on “Organization of management, enforcement of temporary custody and detention under the provisions of the Law on Temporary Custody and Detention Enforcement in 2015” which was entrusted by the Ministry of Public Security.
